Article 1 - Purpose

These terms and conditions govern the sales by Jules Cotte in Saint Rémy de Provence of paintings.

Article 2 - Prices

The prices of our products are indicated in euros and dollars, including all taxes (VAT and other applicable taxes on the day of the order), unless otherwise stated, and excluding processing and shipping fees.

For orders to countries other than mainland France, you are the importer of the products concerned. Customs duties or other local taxes, import duties, or state taxes may be required. These duties and sums are not under the responsibility of Jules Cotte. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the competent authorities and bodies in your country. We advise you to check these aspects with your local authorities.

All orders, regardless of their origin, are payable in euros.

Jules Cotte reserves the right to modify its prices at any time, but the product will be invoiced based on the rate in effect at the time of order confirmation and subject to availability.

The products remain the property of Jules Cotte until full payment of the price.

Note: Once you physically take possession of the ordered products, the risk of loss or damage to the products is transferred to you.

Jules Cotte reserves the right not to record a payment or confirm an order for any reason, especially in the event of supply problems or difficulties related to the received order.

Article 4 - Order Validation

Any order placed on the website jules-cotte.com implies adherence to these General Terms and Conditions. Any confirmation of an order implies full acceptance of these general sales conditions, without exception or reservation.

All the data provided and the recorded confirmation will constitute proof of the transaction.

You declare that you are fully aware of this.

The order confirmation will be considered as a signature and acceptance of the operations carried out.

A summary of your order information and these General Terms and Conditions will be sent to you in PDF format via the email confirming your order.

Article 5 - Payment

Validating your order implies the obligation to pay the indicated price.

Payment for your purchases is made by credit card using the secure SSL system.

The card is only debited when the order is shipped. In the case of partial shipments, only the shipped products will be charged.

Article 6 - Withdrawal

In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from the receipt of your products to exercise your right of withdrawal without having to justify reasons or pay penalties.

Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your responsibility is engaged. Any damage to the product during this time may nullify the right of withdrawal.

Return costs are your responsibility.

If the right of withdrawal is exercised, Jules Cotte will refund the amounts paid within 14 days following notification of your request and via the same payment method used for the order.

EXCEPTIONS TO THE RIGHT OF WITHDRAWAL

In accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:

  • The supply of services fully executed before the end of the withdrawal period, with execution having started after the express prior agreement of the consumer and express renunciation of the right of withdrawal.
  • The supply of goods or services whose price depends on fluctuations in the financial market beyond the trader's control and likely to occur during the withdrawal period.
  • The supply of goods made to the consumer's specifications or clearly personalized.
  • The supply of goods that may deteriorate or expire rapidly.
  • The supply of goods that have been unsealed by the consumer after delivery and cannot be returned for hygiene or health protection reasons.
  • The supply of goods that, after delivery and by their nature, are inseparably mixed with other items.
  • The supply of alcoholic beverages where delivery is deferred beyond thirty days, and the agreed value at the conclusion of the contract depends on market fluctuations beyond the professional's control.
  • The supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery.
  • The supply of a newspaper, periodical, or magazine, except for subscription contracts to such publications.
  • Transactions concluded during a public auction.
  • The supply of digital content not provided on a tangible medium whose execution began after the express prior agreement of the consumer and renunciation of the right of withdrawal.

Article 7 - Availability

Our products are offered as long as they are visible on the website jules-cotte.com and within the limits of available stock. For non-stocked products, our offers are valid subject to availability from our suppliers. In the event of product unavailability after your order is placed, we will notify you by email. Your order will be automatically canceled, and no bank charge will be made.

Additionally, the website jules-cotte.com does not intend to sell its products in large quantities. Therefore, Jules Cotte reserves the right to refuse orders for 2 identical items.

Article 8 - Delivery

The products are delivered to the delivery address indicated during the ordering process, within the time specified on the order confirmation page.

In case of delayed shipment, an email will be sent to inform you of any possible impact on the delivery time.

In accordance with legal provisions, in case of delivery delay, you have the option to cancel the order under the conditions and procedures defined in Article L 138-2 of the Consumer Code. If you receive the product meanwhile, we will proceed with the refund and shipping costs under the conditions of Article L 138-3 of the Consumer Code.

In the case of deliveries by a carrier, Jules Cotte cannot be held responsible for delayed delivery due solely to the customer's unavailability after several delivery appointments.

Article 9 - Warranty

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided by Articles 1641 and following of the Civil Code. In case of non-conformity of a product sold, it may be returned, exchanged, or refunded.

The products must be returned to us in the condition in which you received them, with all components (accessories, packaging, instructions...). The shipping costs will be refunded based on the invoiced rate, and the return costs will be refunded upon presentation of receipts.

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided for in Article 6.

Article 10 - Liability

The products offered comply with French legislation. Jules Cotte cannot be held responsible in case of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibility of importing or using the products or services you intend to order.

Moreover, Jules Cotte cannot be held responsible for damages resulting from misuse of the purchased product.

Finally, Jules Cotte cannot be held responsible for any inconveniences or damages inherent to the use of the Internet, including service interruptions, external intrusion, or the presence of computer viruses.

Article 11 - Applicable Law in Case of Disputes

The language of this contract is French. These sales conditions are subject to French law. In case of a dispute, the French courts will have exclusive jurisdiction.

The computerized records of Jules Cotte will be considered by all parties involved as proof of communications, orders, payments, and transactions between the parties.
